1. About Tia

Tia operates a peer-to-peer marketplace via mobile app and website (clubtia.com) enabling lenders to rent items to borrowers. The company does not act as an agent for either the Borrower or the Lender in any capacity.

By using our platform, you agree to these Terms of Service and acknowledge that the contractual relationship for any rental is directly between the lender and borrower.

2. General Service Terms

Eligibility

Users must be at least 18 years old with legal capacity to enter into contracts. Account registration requires accurate personal information and a strong password.

Prohibited Activities

The platform prohibits:

• Illegal activity of any kind
• Fraud or misrepresentation
• Hacking or unauthorized access attempts
• Harassment of other users
• Unauthorized use of content
• Off-platform transactions

3. Privacy & Communications

Users consent to receive promotional communications upon registration, with options to unsubscribe or delete accounts at any time. See our Privacy Policy for full details on how we handle your data.

4. Lender Responsibilities

As a lender, you must:

• Ensure listings are accurate and items are as described
• Ensure items are fit for purpose and in good condition
• Set clear rental fees, cancellation policies, and damage terms
• Provide condition photos within 24 hours before dispatch
• Handle all cleaning responsibilities
• Respond to inquiries in a timely manner

5. Borrower Obligations

As a borrower, you must:

• Return items by the agreed date
• Return items in their original condition
• Not attempt to clean items (return to lender for professional cleaning)
• Bear responsibility for shipping arrangements
• Accept liability for any damage caused during your rental period

Late Returns

Late returns may incur daily fees, potentially capping at the replacement value of the items.

6. Payment & Fees

All transactions occur through Stripe, our secure payment partner.

• Borrowers are charged immediately upon booking acceptance
• Payment is held securely until the rental period ends
• Lenders receive payment within 10 working days after rental completion
• Damage charges and late fees may be deducted from borrower accounts
• Off-platform payments violate these terms and void any protections

Club Tia currently does not charge commission on rentals, though Stripe processing fees apply.

7. Liability Limitations

Tia disclaims responsibility for:

• Item quality or accuracy of listings
• User disputes between lenders and borrowers
• Shipping issues or items lost in transit
• Damage to items during rental periods

The company's liability is limited to the Rental Fee payable in connection with that transaction.

8. Dispute Resolution

Users may request mediation within 7 days of rental completion. To initiate a dispute:

• Gather supporting evidence (photos, messages, receipts)
• Contact the other party first to attempt resolution
• If unresolved, contact hello@clubtia.com with all documentation

Tia provides mediation support but the final resolution is between the lender and borrower.

9. Account Termination

We reserve the right to suspend or terminate accounts that:

• Violate these Terms of Service
• Engage in fraudulent activity
• Repeatedly receive negative reviews or complaints
• Attempt to conduct transactions outside the platform

10. Changes to Terms

We may update these terms from time to time. Continued use of the platform after changes constitutes acceptance of the new terms. We will notify users of significant changes via email or in-app notification.
